1. Acceptance of Terms

By accessing and using GPSRPass ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GPSRPass provides tools and templates for generating GPSR (General Product Safety Regulation) compliant labels, Declaration of Conformity (DoC) documents, and related compliance documentation for products sold on eMAG and other EU marketplaces.

3. Limitation of Liability

GPSRPass and its operators shall not be held liable for:

• Customs rejections or delays related to documents generated using the Service
• Product recalls, fines, or penalties imposed by regulatory authorities
• Any direct, indirect, incidental, or consequential damages arising from use of the Service
• Incorrect information provided by users that results in non-compliant documentation

Users acknowledge that compliance with EU regulations is their sole responsibility, and GPSRPass serves only as a formatting and organizational tool.

4. Refund Policy

We encourage users to take advantage of our free tier to evaluate the Service before committing to a paid subscription.

5. User Responsibilities

As a user of GPSRPass, you agree to:

• Provide accurate and truthful information about your products
• Verify that generated documents meet the requirements of applicable regulations
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations in your jurisdiction
• Not use the Service for any unlawful or fraudulent purposes

6. Violation Handling and Account Termination

GPSRPass reserves the right to take action against users who violate these Terms of Service, applicable laws, or whose use of the Service poses a risk to other users, the platform, or third parties. The measures below are intended to be proportionate to the severity and recurrence of the violation.

6.1 Grounds for Action

We may take action where a user:

• Breaches any obligation set out in Section 5 (User Responsibilities)
• Engages in fraudulent activity, including misrepresentation of products, fraudulent payment methods, or abuse of promotional credits
• Uses the Service to generate documents that facilitate unlawful trade, counterfeit goods, or non-compliant products posing safety risks
• Attempts to circumvent technical limits, reverse-engineer the platform, or interfere with other users' accounts
• Is required to be suspended or terminated by law, regulation, court order, or payment processor directive

6.2 Enforcement Measures

Depending on the severity, frequency, and intent of the violation, GPSRPass may apply one or more of the following measures, generally from least to most severe:

• Warning — a written notice describing the violation and requesting corrective action within a stated period.
• Feature restrictions — temporary limitation of specific features (for example, blocking downloads, generation quotas, or template access) while the matter is reviewed.
• Account suspension — temporary full or partial disablement of the account for a defined period, during which no charges accrue and no credits are consumed.
• Account termination — permanent closure of the account. All associated data, generated documents, and history will be deleted in accordance with our Privacy Policy.
• Forfeiture of unused credits or balance — upon termination for serious or repeated violation, any unused purchased credits or remaining prepaid balance are forfeited and non-refundable. This does not affect your statutory rights.
• Legal referral — where the activity is unlawful, we may report it to the relevant authorities and cooperate with their investigation.

6.3 Notice

Before applying any enforcement measure other than a warning, GPSRPass will notify the user at the email address associated with the account, stating the reason for the action and, where applicable, the steps required to remedy the situation. In cases requiring immediate action — such as suspected fraud, security incidents, or legal compulsion — we may act without prior notice and inform the user afterwards.

6.4 Right to Appeal

A user affected by feature restrictions, suspension, or termination may submit an appeal by emailing [email protected]within 15 business days of receiving the enforcement notice. The appeal should include the user's account email and a clear statement of the facts. GPSRPass will review and respond within 15 business days. Submitting an appeal does not automatically lift the measure under review.

6.5 Refunds on Termination

If GPSRPass terminates an account for reasons other than the user's breach (for example, discontinuation of the Service), any prepaid but unused portion of a subscription may be refunded on a pro-rata basis, subject to applicable payment-processor rules. If termination results from the user's breach, Section 6.2 (Forfeiture) applies and no refund of credits, prepaid balances, or subscription fees will be issued, except where required by mandatory consumer-protection law.

6.6 Voluntary Account Deletion

A user may delete their account at any time by contacting [email protected]. Deletion does not relieve the user of obligations accrued before deletion (for example, outstanding fees), and Sections 3, 5, 6, and 9 survive termination to the extent necessary to give them effect.

7. Intellectual Property

All content, features, and functionality of GPSRPass, including but not limited to text, graphics, logos, and software, are owned by GPSRPass and are protected by international copyright, trademark, and other intellectual property laws.

Documents generated using the Service belong to the user, subject to proper use of the platform.

8. Modifications to Service

GPSRPass reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms of Service from time to time. Continued use of the Service after any changes constitutes acceptance of the new terms.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the European Union. Any disputes arising from these terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of the European Union.
